The landscape company removed the new growth from tree stumps in order to achieve view clearance for the association. The lawsuit had dragged on for quite some time because both sides had reached an impasse. Both sides were miles apart on the approach to the project's planting needs and the appraised value of the damaged trees. There was a dispute whether the stump sprouts had diminution value or not. Furthermore, the parties could not reach an agreement on new tree plantings that could accommodate views and still meet state tree planting and irrigation guidelines.
Our firm helped bring clarity to the situation and helped minimize damages for our client by
accurately appraising damaged trees along the freeway. In addition, we were instrumental in contributing to the design, oversight of the irrigation system and installation of the planting of new trees. Our sensible planting and tree recommendations provided the least impact to the homeowners while meeting Cal Trans' long term planting and irrigation requirements.
